What is a surplus funds claim?
When a property is sold at foreclosure or tax sale for more than the amount owed to the foreclosing party (mortgage lender or tax authority), the excess amount is called "surplus funds." The former property owner and certain other parties may have a legal right to claim those funds. A surplus funds claim is the legal right to recover that excess amount.
Who can use MissingSurplus?
MissingSurplus serves former property owners and their authorized legal representatives, including estates, heirs, executors, administrators, guardians, trustees, and attorneys. All entitlement and authority are subject to verification under applicable law.
How much will MissingSurplus pay for my claim?
For standard qualifying claims, MissingSurplus targets a purchase price of at least 75% of verified expected recovery. Each claim is individually underwritten based on expected recovery, timing, documentation, competing interests, risk, and applicable law. This is an internal standard, not a guarantee.
Do I need a lawyer?
You are not required to have a lawyer to work with MissingSurplus, though you are always free to consult one. We are not a law firm and do not provide legal advice. All documentation is prepared in compliance with applicable state law, and we recommend you review it carefully before signing.
What if MissingSurplus cannot make an offer?
If your claim cannot support a purchase offer consistent with our Fair Offer Standard, we may recommend recovery assistance, self-recovery guidance, or independent legal review. There is no obligation to proceed with any service.
How long does the process take?
Initial evaluation typically takes 3-5 business days after we receive complete information. The overall timeline depends on the complexity of the claim, the responsiveness of the fund holder, and whether additional documentation or legal review is required.
Is there any cost to submit an evaluation request?
No. Submitting a claim evaluation request is free and carries no obligation. You may decline any offer or recommendation at any time.
Can I pursue the claim myself instead?
Yes. The former owner or authorized representative may always pursue the claim directly through the applicable court, clerk, county, trustee, treasurer or government agency. MissingSurplus provides information to help you understand your options.
What happens to my personal information?
MissingSurplus takes privacy seriously. Your information is used only to evaluate your claim and communicate with you. We do not sell or share your personal information with third parties for marketing purposes.
Is MissingSurplus a government agency?
No. MissingSurplus is a private company. We are not a government agency, court, or law firm. Eligibility, ownership and claim priority are determined under applicable law and, where necessary, by the relevant court, government agency or other authorized holder.
